What is Trust Administration?

Trust administration is the process of managing and carrying out the instructions of a trust. When the person who created a trust passes away, the successor trustee named in the trust generally takes responsibility for managing the trust and its assets for the benefit of the beneficiaries.

The trustee may be responsible for identifying and managing trust assets, communicating with beneficiaries, making distributions according to the terms of the trust, maintaining records, and completing the necessary administrative steps to settle or continue the trust.

  • Maintaining Records: Keeping records of trust assets, income, expenses, distributions, and other transactions.

  • Coordinating with Professionals: Working with attorneys, accountants, financial advisors, and other professionals when appropriate.

Completing the Administration: Taking the necessary steps to settle the trust and distribute or continue managing assets according to the trust's terms. 

Trust Administration vs. Probate Administration

Trust administration and probate administration are two different processes.

When a person dies with a living trust, the successor trustee generally takes over management of the assets held in the trust. If the trust was properly funded, those assets may be distributed according to the trust without going through the probate process.

When a person dies with assets that require probate, the estate is generally handled by a personal representative. If there is a will, the person named in the will is generally the executor and must be appointed by the court. If there is no will, the court may appoint an administrator, often giving priority to a surviving spouse or other close relative under California law.

Trustee, executor, and administrator are not interchangeable terms. The appropriate role depends on how the person's assets were owned and whether a trust or probate proceeding is involved.
